Jerseyheaven respects the work of designers, photographers, illustrators and writers, and we expect the same respect from everyone who uses our site. This page explains how to tell us if you believe something on https://jerseyheaven.com infringes your copyright, what information a notice needs, how we respond, and how someone whose content was removed can respond. Trademark questions, such as the use of a team name or logo, are handled under our Intellectual Property Policy.

1. What this page covers

Jerseyheaven is a single online store selling its own range of sports-style jerseys and fan apparel. We do not run a marketplace and there are no third-party sellers on our site. This process therefore covers material that we publish ourselves, such as product images, garment designs and graphics, product descriptions, size and care guides, banners and blog articles, and any content customers submit to us that appears on the site, such as reviews or photos.

The process follows the notice-and-takedown procedure of the United States Digital Millennium Copyright Act, 17 U.S.C. § 512, and we apply the same approach to notices from rights holders in Canada, Australia, New Zealand and elsewhere. We have not registered a designated agent with the U.S. Copyright Office; copyright notices for this site should be sent to the support address on this page, which is monitored by our team.

2. Before you send a notice

Many concerns can be resolved quickly with a simple message, so it is worth checking a few things first. Make sure the material is on jerseyheaven.com and not on another website that uses a similar name. Consider whether the use may be authorised, for example because we have a licence, or permitted by law, such as a short quotation. Remember that sports-style designs often share common elements, such as stripes, piping, number fonts or a two-colour body, which are generally not owned by any one person. If you are not sure whether something infringes your rights, you may want legal advice before sending a formal notice, because the law treats notices seriously (see section 7).

3. What a copyright notice must include

To be complete, your written notice must include:

  1. a physical or electronic signature of the copyright owner or of a person authorised to act on the owner’s behalf;
  2. identification of the copyrighted work you believe has been infringed, for example a link to your original artwork, photo or text, or a description if it is not online;
  3. identification of the material on our site that you believe infringes, with the exact URL of each page and, where helpful, a description or screenshot so we can find it, such as “the main product photo on this page”;
  4. your name, postal address, telephone number and email address so we can contact you;
  5. a statement that you have a good-faith belief that the use of the material in the manner complained of is not authorised by the copyright owner, its agent or the law;
  6. a statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or are authorised to act on the owner’s behalf.

Send the notice to support@jerseyheaven.com with the subject line “Copyright notice”, or by post to Jerseyheaven, 801 E Locust St, Fort Branch, IN 47648-1217, United States. Email is faster. If your notice is missing an element, we will tell you what is needed, but incomplete notices take longer to resolve.

4. A simple way to structure your notice

You do not need special forms or legal wording. A clear email that follows the outline below contains everything we need:

  • Subject: Copyright notice: [short description, for example “product photo on baseball jersey page”].
  • Your details: full name, company if any, postal address, phone number and email address, and your relationship to the work (owner, or agent acting for the owner).
  • Your work: what it is, when it was created or first published, and a link or attachment showing it.
  • Our material: each URL on jerseyheaven.com, and which image or passage on that page you mean.
  • Statements: the good-faith statement and the accuracy statement under penalty of perjury from section 3, in your own words.
  • Signature: your typed full name is accepted as an electronic signature.

If you are writing on behalf of a client or a company, please include evidence that you are authorised to act, such as a letter of authority, so we do not have to come back to you before acting.

5. Rights holders outside the United States

Many of our customers are in Canada, Australia and New Zealand, and we welcome notices from rights holders in any country. You can follow the same six-element format; you do not need to rely on United States law to ask us to remove infringing material. If your local law gives you additional rights or a different procedure, tell us which law you are relying on and we will consider your notice under it as well. Notices can be written in English; if you send one in another language, our reply may take a little longer while we arrange a translation.

6. How we handle a notice

If the material is one of our own product images or designs, we also review the product itself. Where appropriate we stop selling the item until the matter is resolved, and we look at how it happened so it does not happen again. If we believe the material is not infringing, for example because we hold a licence, we explain our reasons and, where we can, share the relevant information with you.

7. Content submitted by customers

If the material was submitted by a customer, for example a review photo, we remove it when the notice is valid and tell the person who submitted it, sharing a copy of the notice. Where the law allows, we withhold your personal contact details from that copy unless they are needed for a counter-notification. We do not publish copyright notices on the site.

8. Counter-notification

If you submitted content that we removed and you believe it was removed by mistake or misidentification, you may send us a counter-notification. It must include:

  1. your physical or electronic signature;
  2. identification of the material that was removed and the location where it appeared before removal;
  3. a statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification;
  4. your name, address and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if your address is outside the United States, any judicial district in which Jerseyheaven may be found), and that you will accept service of process from the person who sent the original notice or their agent.

We forward a valid counter-notification to the person who sent the original notice. Unless they tell us within 10 to 14 business days that they have filed a court action to stop the infringement, we may restore the material.

9. False or misleading notices

Under 17 U.S.C. § 512(f), any person who knowingly and materially misrepresents that material is infringing, or that it was removed by mistake, may be liable for damages, including costs and legal fees. Please only send a notice or counter-notification if you honestly believe it is correct. Using this process to remove content for reasons other than copyright, such as competition or a disagreement about a product, is an abuse of the process.

10. Repeat infringement

We remove content from, and may close the accounts of, customers who repeatedly submit material that infringes other people’s copyright. We also review our own design and image sources regularly so that the products we sell use original or properly licensed work.

11. How we keep our own range original

Our jerseys and fan apparel are sports-style designs created by or for Jerseyheaven. We do not knowingly use artwork, photographs or text owned by someone else without permission. Product images on our site show our own products or previews of our own designs. When we work with designers or photographers, we agree in advance that we have the right to use their work. If you see a Jerseyheaven design or photo being used elsewhere without our permission, we would also like to hear about it at the same email address.

12. Examples of what to report here

  • A product photo on our site that you took and did not license to us.
  • Artwork on one of our garments that copies an illustration you created.
  • Text in a product description or guide copied from your website or publication.
  • A customer review photo that is your copyrighted image.

Concerns about team names, league logos, slogans or a player’s name or likeness are trademark or publicity matters rather than copyright; please follow the process in our Intellectual Property Policy so they reach the right review.

13. Information we keep

We keep copies of notices, counter-notifications and our correspondence for as long as needed to handle the matter and to meet legal obligations. We use the personal information in them only for that purpose and as described in our Privacy Policy.
